Federal Government’s Disclosure Obligations of Information or Evidence to the Defendant

The federal government is required to disclose any relevant information or evidence to the defendant when the defendant requests disclosure of such information. The defendant should file a motion requesting the disclosure of the federal government’s evidence. The defendant should be provided with liberal discovery.

Mortgage Fraud

Mortgage fraud has become a more prevalent crime in the past few years. In the last two to three years, the number of mortgage companies has increased at a rate of at least 50%. As a result of the increase in the number of mortgage companies, mortgage brokers seem to be engaging in more and more fraudulent types of conduct. The Federal Bureau of Investigation has cited an increase in the number of cases involving fraud and mortgage brokers.

Opening Statements During a Criminal Trial

In a criminal proceeding, each side has the opportunity to present an opening statement to the judge or jury. The prosecution presents its opening statement first and then the defendant presents his opening statement. In some states, the trial judge permits the defendant to defer giving his opening statement until the close of the prosecution’s case. If there are multiple defendants being tried in one case, each attorney may give an opening statement for each defendant.

Scientific Evidence

Scientific evidence constitutes evidence that has been developed through some sort of scientific method. Usually scientific evidence is information that has been published in periodicals and tested by scientists or professionals. This scientific information is considered to be valid within the scientific community.

Statements of Juveniles

After juveniles have been arrested, they have the right to receive Miranda rights and the right to be represented by counsel. The juvenile also has the right to be free from self-incrimination as provided under the Fifth Amendment to the United States Constitution.
